Redundancy consultation

Employment lawyer Jahad Rahman gives his view on the recent changes to collective redundancy consultation in Wharf News.

On April 6, the law requiring companies to consult with trade unions or elected employee representatives over collective redundancies changed to lessen the burden on employers. Collective consultation is mandatory where an employer proposes to dismiss as redundant 20 or more employees within a period of 90 days.

The consultation period has now been reduced from 90 days to 45 days, where 100 or more redundancies are proposed. A 30-day period applies in cases of 20 to 99 redundancies. Another change is that dismissals which occur on the expiry of fixed term contracts will no longer be subject to the collective consultation obligation.
