Data transfers under the GDPR in the event of a no-deal Brexit

The European Data Protection Board has published new guidance for stakeholders on data transfers under the GDPR if the UK leaves the EU without a deal in place.
The European Data Protection Board has published the following guidance to help stakeholders prepare for a no deal Brexit: Information note on data transfers under the GDPR in the event of a no-deal Brexit.The guidance covers information to commercial and public organisations on these transfer instruments under the GDPR for the transfer of personal data to the UK in the event of a no- deal Brexit, including:

• identification what processing activities will imply a personal data transfer to the UK

• determination of the appropriate data transfer instrument for your situation

• implementation of the chosen data transfer instrument to be ready for 30 March 2019

• indication in your internal documentation of transfers that will be made to the UK

• update to privacy notice accordingly to inform individuals
